Information about legal proceedings
The Data Protection Act 1998, Section 35 identifies that Personal data are exempt from the non-disclosure provisions where the disclosure is required by or under any enactment, by any rule of law or by the order of a court.
Or,
Personal data are exempt from the non-disclosure provisions where the disclosure is necessary—
(a) for the purpose of, or in connection with, any legal proceedings (including prospective legal proceedings), or
(b) for the purpose of obtaining legal advice,
or is otherwise necessary for the purposes of establishing, exercising or defending legal rights.
Therefore Nottinghamshire Police may consider disclosure of information associated with criminal activity to 3rd parties, once criminal proceedings have concluded, where it is satisfied that the above exemption applies.
In order to achieve this satisfaction Section 35 requests must be submitted by a Legal Organisation (such as Solicitors or Barristers) or if an individual is representing themselves then proof of listing in Court before any disclosure may be considered.
