Upcoming misconduct hearing for two Police Constables

PC 1206 Poppy Castle and PC 1731 Joseph Wiley are to attend a misconduct hearing at Nottinghamshire Police Headquarters, Sherwood Lodge, Arnold, Nottingham, NG5 8PP, from Monday 21 to Wednesday 23 September, commencing at 9am.

Nature of the misconduct allegation

On 25 September 2023, both officers attended a report of a domestic incident at an address in Nottinghamshire concerning Person A who was arrested by the officers and taken into custody.

It is alleged that during the incident with Person A, PC Castle's conduct:

• Lacked integrity by requesting PC Wiley turn his body worn video off so as not to record derogatory comments made towards Person A

• Lacked respect and courtesy for Person A and or police colleagues when requesting the body worn video was turned off and making derogatory comments towards Person A and their son, Person B

• Was discriminatory towards Person A, when informed by Person A of their neurodiversity

• Was discriminatory and lacked fairness and impartiality when using abusive language about Person B

• Undermined public confidence in the police

It is alleged that during the incident with Person A, PC Wiley's conduct:

• Lacked integrity when he turned his body worn video off

• Lacked respect and courtesy towards Person A and or police colleagues by not challenging comments made by PC Castle and when making disrespectful comments towards Person A and about police colleagues

• Lacked respect and courtesy when making disrespectful comments about Person A and Person B

• Was discriminatory when using abusive language about Person A's vulnerabilities and or neurodiversity

• Was discriminatory and lacked fairness and impartiality when using abusive language about Person A and Person B

Members of the public and the media may attend subject to the following conditions:

• Any member of the public or accredited member of the media wishing to attend the hearing must produce valid identification.

• No person present at the hearing shall cause the true identity of Person A or Person B to be written down, recorded and/or otherwise transmitted to any person outside of the hearing.

• If there are parts of the hearing which the chair directs to be held in private, any member of the media or press attending the hearing will be asked to leave during the private hearing and will be informed by the Hearings Officer when they can return.

If any member of the public or media wishes to observe this hearing, please pre-register by using the online registration form before 4pm on Wednesday 16 September.

Anyone who has not pre-registered will not be accepted into the hearing. You will be informed by the Hearings Officer by 5pm on Friday 18 September if you have been reserved a place.

Conditions of entry:

All attendees will need to provide identification on the day of admittance to the misconduct hearing to allow verification of their identity. They will also have to sign to adhere to a number of conditions allowing them entry.

No recording or filming of the proceedings is allowed.
